Terms of Service

1. Acceptance of Terms

By accessing or using GoPixel's services (formerly Hind Cloud), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

GoPixel provides digital services including but not limited to web development, brand identity design, graphic design, UI/UX design, SEO, digital marketing, and e-commerce solutions.

3. Project Agreements & Scope

• All projects begin with a written agreement detailing scope, deliverables, timeline, and cost.
• Any changes to the agreed scope may result in additional charges and timeline adjustments.
• Clients must provide required content, assets, and feedback within agreed timeframes.
• Delays caused by the client may affect delivery timelines without penalty to GoPixel.

4. Payment Terms

• Projects typically require 50% advance payment before work commences.
• Remaining balance is due upon project completion before final files/access are delivered.
• Milestone-based payments may be agreed upon for larger projects.
• Overdue invoices may incur a late fee and suspension of services.

5. Intellectual Property

• Upon receipt of full payment, clients receive full ownership of all custom deliverables created for them.
• GoPixel retains the right to showcase completed work in its portfolio unless specifically requested otherwise in writing.
• Third-party assets (stock photos, fonts, plugins) remain subject to their respective licenses.
• Source files are transferred only if specifically included in the project agreement.

6. Revisions & Approvals

Each project phase includes a specified number of revision rounds as agreed upon. Additional revisions beyond the agreed scope will be charged at our standard hourly rate. Client approval at each milestone is required to proceed.

7. Client Responsibilities

• Provide accurate and complete information required for project completion.
• Ensure all content provided does not infringe on any third-party intellectual property rights.
• Provide timely feedback and approvals to maintain project timelines.
• Maintain secure access credentials provided by GoPixel.

8. Warranties & Disclaimers

GoPixel warrants that all work will be completed with reasonable skill and care. We do not guarantee specific business outcomes (e.g., search engine rankings, conversion rates) as these depend on many factors beyond our control.

9. Limitation of Liability

GoPixel's liability in any matter is limited to the total amount paid by the client for the specific service in question. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Either party may terminate the engagement with 14 days' written notice. In the event of termination, payment is due for all work completed to date. Any advance payments for uncompleted work may be refunded subject to our Refund Policy.

11. Confidentiality

Both parties agree to keep all project-related information confidential and not to disclose it to third parties without written consent, except as required by law.

12. Governing Law

These terms are governed by the laws of India. Any disputes shall be resolved through mutual negotiation and, if necessary, through appropriate legal channels in India.

13. Brand Transition Note

These terms supersede any previous agreements made under the Hind Cloud brand. Existing Hind Cloud clients are now served under the GoPixel brand with the same team and commitment.
